Clement, Solicitor General On October 20, 1999, the InternationalCenter for Technology Assessment and several other parties filed a rulemakingpetition asking the Environmental Protection Agency (EPA) to regulate emissionsof carbon dioxide, methane, nitrous oxide, and hydrofluorocarbons from newmotor vehicles. In August 2003, the EPA ruled that the Clean Air Act (CAA) didnot give it the authority to do so. A group of States, cities, andenvironmental organizations, led by Massachusetts, challenged the EPA’sdecision in the U.S. Court of Appeals for the District of Columbia Circuit,which, on July 15, 2005, held in favor of the EPA and a number of industrygroups…
