Under the policy, Earl and James would have to submit to drug tests if they wanted to continue to compete in their chosen extracurricular activities. They, and their parents, filed suit against the school district and its board in August 1999, alleging that the drug tests were unconstitutional because the possible benefits of the policy were far outweighed by the resulting invasion of their privacy.
