Michigan and Ohio are joined in this brief by 18 other States. Aaron D. Lindstrom has served as Michigan’s solicitor general since December 2014. The following is excerpted from the Amicus Curiae Brief for Respondents as submitted to the U.S. Supreme Court on January 27, 2014. The threshold question here is whether for-profit, secular businesses may exercise religion and therefore fall within the religious liberty protections of the Religious Freedom Restoration Act (RFRA). It is a question that is basic to American democracy. Its answer requires this Court to return to first principles. And the answer is a simple one….
