The Fifth Amendment to the U.S. Constitution provides that no person shall “be subject for the same offense to be twice put in jeopardy of life and limb.” This “double jeopardy” clause prevents individuals from being tried multiple times for the same criminal offence. The U.S. Supreme Court has ruled that there is an exception to this clause, however, when the prosecutions are being brought by a State (or tribal Indian court) and the Federal Government.
