Drug testing has been a weapon in our Nation’s efforts to control the use of cocaine and other narcotics for many years. Since 1989, the U.S. Supreme Court has considered the constitutionality of drug-testing laws on four separate occasions.The Court has upheld testing of athletes in public schools, of U.S. Customs agents seeking employment in sensitive positions, and of railroad employees involved in accidents.
