Later that year, the government added 56 counts of mail fraud, six counts of Medicaid fraud, one count of money-laundering, and an additional count of conspiracy and attempted murder of a witness and an FBI agent. On April 14, 1999, the presiding judge ruled Sell unable to stand trial due to a diagnosed "delusional disorder."
