The United States was a party to this case in the lower courts, defending the Federal Defense of Marriage Act (DOMA) against a constitutional challenge. After appeal to the U.S. Supreme Court, however, the United States switched sides and is now arguing that Section 3 of the Act be struck down. It is still considered a petitioner in this case for Court purposes, although it is arguing that the Court uphold the lower court decision. Donald B.
