Section 875(c) of Title 18 of the United States Code makes it a crime to transmit “in interstate or foreign commerce any communication containing any threat to kidnap any person or any threat to injure the person of another,” with punishment ranging from a fine to five years in prison. On December 8, Anthony D. Elonis was arrested on five counts of violating this statute for allegedly making threats on Facebook against employees of a local amusement park, his estranged wife, local law enforcement, a kindergarten class, and a Federal Bureau of Investigation agent.
