The following is excerpted from the Amici Curiae Brief for Respondents as submitted to the U.S. Supreme Court on Aug. 15, 2023. In today’s world, social media is an important tool for communications of all stripes. The First Amendment guarantees public officials’ freedom to speak through these new tools in their private capacities.
