On Election Day in November 2010, Andrew Cilek entered his polling place to vote. He was wearing a t-shirt with a grassroots conservative Tea Party logo and the “Don’t Tread on Me” Gadsden flag, along with a button that read “Please I.D. Me.” He was informed that Minnesota required that he cover all political badges, buttons, and insignias if he wanted to cast a ballot.
