Major Provisions of S. 96, the Y2K Act
The Y2K Act (S. 96), introduced by Senator John McCain (AZ-R)on January 19, 1999, is applicable to any Y2K action brought ina Federal or State court after February 22, 1999, and inapplicableto a claim for personal injury or wrongful death. The Y2K Actpreempts inconsistent State law.The Act mandates that, in any Y2K action in which punitivedamages may be awarded under applicable State law, the defendantshall not be liable unless the plaintiff proves that the defendantacted with conscious and flagrant disregard for the rights andproperty of others.
