Defining a “Seizure” Under the Fourth Amendment
Early in the morning on July 15, 2014, New Mexico State Police officers went to an apartment complex in Albuquerque to arrest a woman, Kayenta Jackson, who was “involved with an organized crime ring.” The officers saw two individuals standing in front of the woman’s apartment next to a Toyota FJ Cruiser. The Cruiser was backed into a parking spot, with cars parked on both sides of it.
