Paul D. Clement, Solicitor General On November 13, 2001, President George W. Bush issued a military order regarding the "Detention, Treatment, and Trial of Certain Non-Citizens in the War Against Terrorism." The document authorized the U.S. military , when necessary, to try enemy combatants captured in Afghanistan and elsewhere before military tribunals for violations of the law of war and other military laws. Since that time, the United States has designated 14 detainees for trial by tribunal, including Salim Ahmed Hamdan — who was captured in Afghanistan and is alleged to have been Osama bin Laden’s personal driver and bodyguard….
