Malone, Counsel of Record The People of the State of New York, along with the public utility commissions of New York, Florida, Wyoming, Idaho, North Carolina, New Jersey, Vermont, Virginia, and Washington, and the National Association of Regulatory Utility Commissioners, filed suit against the Federal Energy Regulatory Commission (FERC), alleging that it had illegally attempted to regulate noninterstate energy transmissions. They charged that, under the 1935 Federal Power Act, Congress allowed FERC to regulate interstate power transmissions, not transmissions within States, even if those transmissions were "unbundled" — listed as a separate item on the consumer’s bill.
