Smaltz, Independent CounselOn September 9, 1994, a three-judge panel named Donald Smaltz to investigate charges that Agriculture Secretary Mike Espy had received improper gifts from companies with business before his department. As a result of that investigation, Sun-Diamond Growers of California was found guilty of giving Espy unlawful gratuities, but the conviction was overturned by the D.C. Circuit Court of Appeals. Prior to being appointed independent counsel, Smaltz practiced law in a small California firm.
