Cameron Devore, Counsel of Record Cable News Network and its parent company Turner Broadcasting, as well as CNN employees Robert Rainey, Donald Hooper, and Jack Hamman, were co-Appellees in Berger, et ux. v. Hanlon, et al. before the Ninth Circuit Court of Appeals. They filed a separate petition for certiorari to the Supreme Court, however, requesting the Court also decide whether members of the news media who observe government agents executing a warrant are State actors such that they may be subjected to constitutional liability as if they were government officers themselves.
