Henry H. Rossbacher, Counsel of Record On March 24, 1993, officials of the U.S. Fish and Wildlife Service, accompanied by reporters from Cable News Network (CNN), searched the ranch of Paul and Erma Berger for evidence that Mr. Berger had been poisoning endangered eagles and other wildlife. Mr. Berger was convicted on a misdemeanor count of using a registered pesticide in a manner inconsistent with its labelling. The Bergers then sued both CNN and the Fish and Wildlife agents for violating their Fourth Amendment protection from unreasonable searches.
