Richard A. Cordray, Counsel of Record Petitioners Hanlon, Scrafford, Branzell, and Prieksat are special agents of the U.S. Fish and Wildlife Service, and Petitioner McLean is an assistant U.S. district attorney for the State of Montana. They were sued in their individual capacities by Paul W. Berger and his wife, Erma R. Berger, for violating the Fourth Amendment right to protection from unreasonable searches by allowing a Cable News Network television crew to accompany them while they executed a search warrant for the Bergers’ Montana ranch.
