In 1976, Congress passed the Magnuson-Stevens Act, which allows the federal government, through the Department of Commerce, to manage and regulate fishing in U.S. waters. The law said the government may require fishing vessels to carry a federal observer to collect data on fishing practices. In 2013, the New England Council, which manages the Atlantic herring fishery, issued a rule requiring fishing companies in the region to pay a fee to cover the cost of its observer program.
