B.P.J. is a high schooler who lives in West Virginia. Assigned male at birth, B.P.J. has identified as a girl since third grade. She has been taking puberty-delaying medication and estrogen therapy to allow her to conform with her gender identity. When B.P.J. was in sixth grade, West Virginia enacted the Save Women’s Sports Act, which banned athletes assigned male at birth from competing in school sports “designated for females, women, or girls.” B.P.J., unable to play on her school’s girls’ cross country team, filed suit against the state, alleging that the law violated her constitutional and legal rights.
