In April 2021, West Virginia enacted the Save Women’s Sports Act, which prohibits male athletes in the state from competing in school sports “designated for females, women, or girls.” It set out that a competitor would be designated male or female “based solely on the individual’s reproductive biology and genetics at birth.” Before the law took effect, the mother of an 11-year-old child who was designated male at birth but identifies as a girl filed suit, alleging that the West Virginia law violated the equal protection clause of the U.S. Constitution and Title IX of the Education Amendments of 1972,…
