Reynolds Tobacco Co., and Philip Morris Inc., sued the State of Massachusetts on May 1, 1998, alleging that the State’s tobacco advertising regulations were preempted by Federal law and violated the companies’ First Amendment right of free speech. At the same time, a group of cigar and smokeless tobacco companies also sued the State on First Amendment grounds alone, as their products were not covered by Federal law.
