Arthur A. Benson, Counsel of RecordDonald J. Gralike was a Democratic candidate for Congress from Missouri during the 1988 election. Because he refused to take a State constitution-mandated pledge to support term limits for Federal elected officials, Missouri law required that the label "DECLINED TO PLEDGE TO SUPPORT TERM LIMITS" appear next to his name on the general election ballot. He filed suit against Missouri Secretary of State Rebecca McDowell Cook in her official capacity, alleging that the Missouri amendment violated his First Amendment right to free speech, in addition to several other constitutional provisions.
