Foreword
Two recurring themes in the Supreme Court over the last decade have been an increased recognition of women’s issues and an effort to define and limit the extent of Federal power. These two trends collide in United States, et al. v. Antonio Morrison and James L. Crawford, as the Court debates the constitutionality of a recent congressional attempt to prevent rape and domestic assaults.The law at issue is the Violence Against Women Act of 1994, which contains a provision allowing women to sue their sexual assailants in Federal court for monetary damages.
