The District of Columbia and New York are joined in this brief by 21 other states. The following is excerpted from the Amicus Curiae Brief for the Appellants as submitted to the U.S. Supreme Court on Sept. 3, 2025. In our initial amicus brief, amici states explained that, even if racial considerations did predominate, Louisiana had the requisite strong basis in evidence to satisfy strict scrutiny because a different federal court had earlier ruled that Louisiana’s original map likely violated Section 2.
