The following is excerpted from the Amicus Curiae Brief for Petitioners as submitted to the U.S. Supreme Court on Oct. 17, 2025. Congress may not bar the president from supervising the officers who exercise executive power on his behalf, including by the threat of removal. The statute purporting to restrict the president’s ability to remove Federal Trade Commission (FTC) commissioners is thus unconstitutional.
